Identification of a jurisprudential guide

​​The Chairperson of the Immigration and Refugee Board of Canada has identified Refugee Appeal Division decision TC1-05038 as a jurisprudential guide.

Jurisprudential guides are tools for decision-makers. They are IRB decisions that model sound decision-making on a topic. The Chairperson of the IRB selects decisions that will become jurisprudential guides. Jurisprudential guides support high-quality, consistent decision-making while respecting decision-makers' independence.

This decision gives guidance on how to properly assess claims for protection from claimants who say they have experienced gang-targeting or other criminal acts. It also sets out a clear way to consider the 'generalized risk' exception to protection under paragraph 97(1)(b) of the Immigration and Refugee Protection Act (IRPA).
