The new IAD Rules have now been published in the Canada Gazette, Part II

The Immigration and Refugee Board of Canada (IRB) is pleased to announce that new Immigration Appeal Division Rules, 2022, have now been published in the Canada Gazette, Part II. These new Rules will come into force on January 14, 2023.

We invite you to read the new Immigration Appeal Division Rules and Regulatory Impact Analysis Statement (RIAS). You can find the full text of the Rules as well as important background information detailing how the new Rules were developed. As one of four Divisions of the IRB, the Immigration Appeal Division (IAD) hears appeals on immigration-related matters. The Rules establish the IAD's procedures for appeals. For example, the IAD Rules lay out the steps and requirements for all parties; explain timeframes for filing an appeal and disclosing documents; and establish the early resolution mechanisms that are available. We will publish updated step-by-step instructions for Making an immigration appeal on the IRB website when the new Rules come into force on January 14, 2023.

The new IAD Rules will:

  • reduce the time it takes to finalize an immigration appeal
  • make it easier to understand the process by simplifying the language and the organization of the Rules
  • reflect digital practices (e.g., electronic submission of documents) that save time and improve service
  • be more consistent with the rules of other IRB Divisions

We are confident the new Rules will help ensure that the IAD fulfills its mandate to resolve appeals efficiently, fairly, and in accordance with the law.
