An investigation found that the Member did not breach the Code of Conduct for Members of the Immigration and Refugee Board of Canada (the Code). The Complainant was the appellant whose case was heard by a member of the Immigration Appeal Division.
The allegation concerned the Member's conduct and was investigated. The Complainant alleged that the Member was annoyed, that they used a humiliating and degrading tone, and that the Member cut off and mocked the Complainant's answers. Upon review, the Ombudsperson found no support for the alleged misconduct. The Chairperson's decision was that there were no breaches of the Code.
