The complaint was screened out after a review determined that the allegations fell outside the jurisdiction of the member complaints process. The Complainant, who was counsel for a person concerned whose detention review was heard by an ID member, alleged that the Member delayed granting a health break to the Complainant by 15 minutes. The delay caused the Complainant extreme discomfort due to an undisclosed health condition.
The Ombudsperson reviewed the complaint and recommended to the Chairperson that, while an unnecessary delay in granting a health break could be within the scope of the member complaints process, in this case the Member waited less than 5 minutes before granting the break. The Chairperson's decision was that the complaint was insufficient to go to investigation, and the file was closed.
