The complaint was resolved through Alternative Dispute Resolution (ADR), and the file was closed.
The Complainant, who was counsel for a refugee claimant, made three allegations following their hearing at the Refugee Protection Division. The Complainant alleged that the Member ignored the claimant after they expressed fear and confusion; that the Member was harsh, spoke in an aggressive and condescending manner, and was hostile towards the parties; and that the Member denied the claimant's request for a break.
The Office of the Ombudsperson contacted both parties, who indicated they would be interested in ADR. After speaking to the Member about the complaint, the Office of the Ombudsperson shared the Member's thoughts and reflections with the Complainant. The Complainant was satisfied and indicated that their concerns were resolved, and the file was closed.
